Eligiblity

You may not become a member if you are under the age of 18 or you are not able to form legally binding contracts. ForKids.Toys reserves the right to amend, remove, or add to these terms and conditions of use at any time without notice. Such modifications shall be effective immediately. Accordingly, please continue to review these terms of use whenever accessing or using this site. If you do not agree with all of the terms of this agreement, do not register or pay for the service.

 

Privacy

ForKids.Toys does not sell, rent or exploit the information provided by you for marketing purposes. The personal information you provide to us will be stored on secured computers and/or servers. You consent to the use of this information to create a profile of interest in one of our subscription service including capturing your preferences and browsing patterns which allow you to participate in the Service. Billing and Payments

By starting your subscription and providing or designating a payment method, you authorize us to charge you on a recurring monthly subscription fee at the then current rate. In addition to applicable shipping and handling charges and any applicable taxes, commencing on the date you purchase your subscription. We reserve the right to adjust pricing for our subscription services in any manner and at any time as we may determine in our sole and absolute discretion. Except as otherwise expressly provided for in these Terms of Service, any price changes to your subscription will take effect following email notice to you providing you an opportunity to cancel the service if you wish that the price change would not be applicable to you.

 

Delivery

ForKids.Toys shall use good faith efforts to deliver the products to the designated address specified by you. Title to the toys passes from ForKids.Toys to you upon shipment from our facility (or, if applicable, the third party manufacturer’s facility). Our shipping service does not include the redirecting or forwarding to an updated address.

As a Member, you agree to the following benefits and Terms:

You must provide us and keep us up to date with accurate contact, payment information. This includes name and shipping address; any address changes must be made before the toys are shipped to you.

Toy Library Limitations:

The ForKids.Toys service enables Members to select a Toy from a catalog of Toys that might change from time to time.

ForKids.Toys does not guarantee the delivery or rental of any kind of Toy.

ForKids.Toys ensures that a toy is rented from its fulfillment center in a clean condition, yet ForKids.Toys cannot guarantee the toy condition following the shipping process.

If a Member cancels their account, all credits available in the account shall be lost and cannot be retrieved upon re-activation.

Upon cancelation, the customer must return any rented toy within 10 days. If the toy/s are not returned within 10 days, the Member will be charged the market price of the toy/s. They charge could not be reversed even if toys were sent back at a later date and the toys could only be sent back upon payment of shipping and handling charges.

 

Membership Cancellation

Should you decide to terminate your membership, you may do so by canceling the service using the "My Account" section on the website. Your membership will be canceled only when the last toy that was sent to you is received by our processing center. If you cancel your membership, you will not receive a refund of any membership credits or fees already paid. When your membership is cancelled, we may terminate your member benefits.

ForKids.Toys reserves the right to terminate or suspend your account at any time, with or without notice, if we determine that you have violated these Terms, or for any other reason.

 

Payment Terms

To the extent you wish to make a purchase using the Service (for example, to purchase individual toys or a Subscription), you will be required to provide ForKids.Toys information regarding your credit card or other payment instrument (such as PayPal). You represent and warrant to ForKids.Toys that such information is true and that you are authorized to use the payment instrument for the initial subscription term and each renewal term. If you use the Service to purchase a Subscription, you will promptly update your account information with any changes (for example, a change in your billing address or credit card expiration date) that may occur. You agree to pay ForKids.Toys the amount that is specified in the Service in accordance with these Terms of Use. If you start a subscription for yourself or as a gift for another and once it is activated by the gift recipient, you hereby authorize ForKids.Toys to bill your payment instrument in advance on a recurring basis in accordance with the terms of the applicable subscription plan until you terminate your account, and you further agree to pay any charges so incurred. You understand and accept that, unless otherwise expressly stated, a subscription operates on an auto-renewal basis such that your credit card or other payment instrument will be automatically charged for the same period as your most recently completed subscription period. Please note that if your subscription includes a discounted product price for a promotional period or a gift card balance, once the promotional period expires or the gift card value is used, your subscription will renew at the full product price. You agree and authorize ForKids.Toys to charge for the loss or major damage beyond repair to the toy which may have caused by yourself or the gift recipient. You will be solely responsible for the payment of all taxes (other than taxes based on Company’s income), fees, duties, and other governmental charges, and any related penalties and interest, arising from the product purchase. All payments made are non-refundable. If you dispute any charges you must let ForKids.Toys know within thirty (30) days after the date that ForKids.Toys charges you. We reserve the right to change ForKids.Toys’s subscription plan prices. If ForKids.Toys does, ForKids.Toys will provide notice of the change on the Site or in email to you, at ForKids.Toys’s option, at least 30 days before the change is to take effect. Your continued use of the Service after the price change becomes effective constitutes your agreement to pay the changed amount.

 

Code of Conduct

 

As a non-registered user or Member of the Site or Application, you agree:

• I will return the toys in a clean and sanitary condition.

• I will treat the toys with care and respect as if it was my own toy.

• I will notify ForKids.Toys of any damage or missing pieces that were lost during the time I rented the LEGO toy and understand that I might be charged the full amount of the toy to replace it.

• I will not post or send any content or engage in any conduct that subjects ForKids.Toys to any threat of civil or criminal penalties.

• I assume all liability for the use of any information I find on the Site.

• I have the authority to enter into this agreement.

 

Intelectual Property

 

The Site, Application and all content contained therein, is protected by copyrights, trademarks, service marks, international treaties and/or other proprietary rights and laws of the U.S. and other countries. ForKids.Toys is also protected as a collective work or compilation under U.S. copyright and other laws and treaties. All individual elements making up the Site and Application are also copyrighted works. You agree to abide by all applicable copyright and other laws, as well as any additional copyright notices or restrictions contained in the site. Copying any content from this site to any other site, or reselling, distributing, or publishing that content in any way is prohibited. Any violation of this paragraph shall subject the violator to severe penalties and you shall indemnify and hold ForKids.Toys harmless from and against any and all costs and damages incurred by ForKids.Toys as a result of such violation. Any photos or descriptions submitted on the Site or Application become the property of ForKids.Toys and you assign to us, with full title guarantee, all copyright with respect to any information and photographs that may be used for promotional or other purposes. ForKids.Toys may remove any identification or watermark language that appear on photographs submitted to the site.

 

Update to These Terms

Please note that these Terms may be revised and reissued, prospectively by posting updated terms on the Site or Application. You consent and agree to receive notices of updates of these Terms through our posting of updated Terms on the Site or Application. ForKids.Toys encourages you to frequently review the Terms for any modifications. Your continued use of the Service will be deemed as irrevocable acceptance of any revisions.

 

Entire Agreement

You acknowledge that you have read these terms of use, understand them and agree to be bound by their terms and conditions. You further agree that it is the complete and exclusive statement of the agreement between us which supersedes any proposal or prior agreement, oral or written, and any other communications between us relating to the subject matter of this agreement.
